Terms of Service

Last updated: October 29, 2026

These Terms of Service ("Terms") govern your use of the MyParkingLots parking payment and management platform operated by PNW Parking, LLC ("we", "us", the "platform"), and by the parking lot owners ("Owners") who use the platform to manage their lots. By scanning a QR code, paying for parking, creating an Owner account, or using any Owner's portal, you agree to these Terms, including the arbitration agreement in section 9. If you do not agree, do not use the service.

1. The service

The platform provides a way for drivers to pay for parking at participating lots using a smartphone (scan a QR code, enter your license plate and payment card, start a session, end it when you leave). Owners use the platform to set rates, generate QR codes, manage enforcement, and view analytics. The platform is a payment facilitator: your parking payment is made to the lot Owner, and the platform receives a service fee.

2. Driver payment terms

  • Authorization hold. When you start a session, your card is authorized for the lot's maximum expected charge (typically the daily cap). You are only charged for the time you actually park, when you end your session.
  • Auto-capture. If you do not end your session, we may automatically charge your card after the lot's configured threshold and local auto-bill time, up to the lot's daily rate.
  • Refunds. Refunds of parking and citation payments are issued by the lot Owner or by platform support, with a recorded reason, to the original payment method. When a driver payment is refunded, the Owner's share is reversed; the platform's service fee is not returned. Payment processor fees are not recoverable. Request a review through the support form or contact platform support at support@myparkinglots.com.
  • Parking passes. A monthly or yearly pass can be cancelled for a refund within 15 minutes of its first payment, from the pass's own page. After that, the refund depends on the pass, as the Owner sets it and as shown when you buy: either there is no refund, or the pass is prorated, meaning cancelling from the pass's page charges you through the end of that day and refunds the remaining days of the period already paid for, and ends the pass. Every pass refund is the refunded amount minus the platform's pass fee and the card processing fee, which are not returned. Turning renewal off ends the pass at the end of the period already paid for.
  • Sales tax. Where required by law, sales tax is added to the amounts we charge and shown on your receipt.
  • Fee changes. We may change platform fees; Owners will be notified in advance where required.

3. Customer obligations

  • Enter accurate license plate, state, and email information at session start. Enforcement relies on plate matching.
  • Comply with the lot's posted signage, rate card, and parking rules.
  • Do not abuse the service (no charge circumvention, no fraudulent disputes, no tampering with QR codes or signage).

4. Tickets and enforcement

Owners may issue citations for non-payment or rule violations. Ticket payments are made through the Owner's payment portal; appeals may be submitted per the process described on the ticket page. Unpaid citations may be escalated per the Owner's policies and applicable law.

5. Owner terms

  • Owners are responsible for configuring accurate rates, fine schedules, and policies, and for complying with local law (taxes, parking regulations).
  • Staff and contractors managed through the platform are the Owner's responsibility; the platform provides tools but does not employ them.
  • PII handled under the platform's PII policy applies to all Owners.
  • Chargebacks. The Owner bears any chargeback or payment dispute on a driver payment made at the Owner's lot, including the disputed amount and any dispute fee. The platform submits evidence on the Owner's behalf, but any resulting loss is the Owner's. We may deduct chargeback amounts from the Owner's upcoming payouts and, if those are insufficient, bill the Owner for the balance.

6. Owner plans, billing and cancellation

  • Billing. Owner plans are billed monthly in advance, starting at signup, to the payment method on file. The per-transaction service fee is charged on each driver payment as described in the Owner's plan.
  • Sales tax. Plan prices and the service fee are listed before sales tax. Sales tax is added where required by law and shown on the invoice.
  • 7-day refund. An Owner may request a full refund of the first month's plan fee within 7 days of signup. After that, plan fees are not refunded, including for partial months.
  • Cancellation. An Owner may cancel at any time from account settings or by contacting platform support. Cancellation takes effect at the end of the current billing period; the Owner keeps access until then and is not charged again. Money already collected for the Owner continues to be paid out on the payout schedule, less any amounts the Owner owes us.

7. Limitation of liability

To the maximum extent permitted by law, the platform is provided "as is", without warranties of any kind. We are not liable for indirect, incidental, or consequential damages, or for lost revenue, disputes, or towing outcomes. Our aggregate liability is limited to the fees you paid us in the 90 days before the claim.

8. Governing law

These Terms, and any dispute between you and us, are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules, except that the Federal Arbitration Act governs the arbitration agreement in section 9.

9. Arbitration agreement and class action waiver

Please read this section carefully. It affects your legal rights.

  • Binding individual arbitration. Except as stated below, you and PNW Parking, LLC agree to resolve any dispute arising out of or relating to these Terms or the service through final and binding arbitration administered by the American Arbitration Association (AAA) under its rules in effect when the claim is filed (its Consumer Arbitration Rules for individual drivers, and its Commercial Arbitration Rules for Owners). The arbitrator, not a court, decides all questions about whether this agreement applies.
  • No class actions. Claims may be brought only on an individual basis, not as a plaintiff or class member in any class, collective, or representative proceeding.
  • Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court to stop infringement or misuse of intellectual property.
  • Opt out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@myparkinglots.com with the subject line "Arbitration opt-out" and your name and account email.
  • Costs and location. Arbitration may be conducted by video or telephone, or in the county where you live if you ask for an in-person hearing. Filing, administrative, and arbitrator fees are allocated under the AAA rules.

10. General

We may update these Terms at any time; material changes will be posted here with a new "Last updated" date. Support, refund, and cancellation requests go to platform support at support@myparkinglots.com.

These Terms are a draft pending review by counsel and are not legal advice.
